1. Health at Time of Sale
The Breeder warrants that the puppy is in good health and free from known infectious or communicable diseases at the time of sale. The Breeder is not responsible for any illness, disease, injury, or condition the puppy may develop after leaving the Breeder’s care, including any preventable disease contracted after delivery or pickup.
The Buyer acknowledges that no refunds or reimbursements will be provided for veterinary expenses, medical treatment, transportation, or shipping costs incurred after the puppy leaves the Breeder’s care.
2. Mandatory Veterinary Examination
The Buyer must have the puppy examined by a licensed veterinarian of the Buyer’s choice within forty-eight (48) hours of delivery or pickup.
A copy of the veterinarian’s examination report must be provided to the Breeder within seventy-two (72) hours of purchase. This examination is mandatory and is a condition of the one-year health guarantee described below. Failure to complete the required veterinary examination and provide the required documentation within the stated timeframes will cause the health guarantee to be null and void.
3. One-Year Genetic Health Guarantee
The Breeder provides a one (1) year health guarantee, beginning on the date of sale identified in the Acceptance section of this Agreement.
This guarantee applies only to life-threatening genetic defects that are not related to known brachycephalic breed characteristics and that were not caused or contributed to by abuse, neglect, accident, injury, bacterial or infectious disease, preventable illness, environmental factors, improper care, or other conditions specifically excluded by this Agreement.
A condition must be determined by a licensed veterinarian to be life-threatening in order to qualify under this guarantee.
If the puppy is diagnosed with a potentially qualifying life-threatening genetic defect, the Buyer must notify the Breeder in writing within seventy-two (72) hours of the diagnosis. The Buyer must provide a written and notarized statement from a licensed veterinarian documenting the diagnosis and stating that the condition is a life-threatening genetic defect. The diagnosis and supporting medical records will be reviewed by a veterinarian designated by the Breeder.
If the Breeder’s veterinarian concurs with the Buyer’s veterinarian that the condition qualifies under this guarantee, the Breeder will provide a replacement puppy of equal purchase value, subject to availability and the terms of this Agreement. The original puppy and any applicable AKC registration papers must be returned to the Breeder before a replacement puppy is provided, unless otherwise agreed to in writing by the Breeder.
The Buyer acknowledges that replacement puppies may not be immediately available. A replacement may require a waiting period of up to one (1) year, depending on the availability of a suitable puppy. The Buyer is responsible for all transportation and shipping expenses associated with the original puppy and any replacement puppy.
Veterinary expenses, diagnostic costs, treatment costs, shipping expenses, and transportation expenses are not refundable.
4. Conditions Not Covered by the Guarantee
This health guarantee does not cover preventable, infectious, environmental, accidental, or naturally occurring puppy conditions, including but not limited to:
The Buyer acknowledges that exposure to infectious diseases can occur after the puppy leaves the Breeder’s care. The Buyer should take appropriate precautions, including avoiding public parks, pet stores, groomers, dog parks, boarding facilities, and other locations with significant dog traffic until the puppy has completed the appropriate vaccination series as recommended by a licensed veterinarian.
The guarantee also does not cover:
Hernias
Open fontanels
Pinched or narrow nostrils
Other non-life-threatening structural or developmental conditions
Conditions associated with normal toy-breed development
Conditions caused by neglect, abuse, accident, injury, improper care, environmental exposure, or failure to follow veterinary or Breeder recommendations
Small umbilical hernias are relatively common in toy breeds and may close naturally as the puppy matures. If surgical correction is necessary, the Buyer is responsible for all associated costs. Hernia repair may sometimes be performed at the time of spay/neuter.
Pinched or narrow nostrils may improve as the puppy matures and are not covered under this guarantee unless specifically determined to constitute a qualifying life-threatening genetic defect under Section 3.
5. Death During the Guarantee Period
If the puppy dies during the one-year guarantee period, the Buyer must notify the Breeder immediately.
The puppy must be properly refrigerated and must never be frozen.
A professional necropsy must be performed by a qualified professional Necropsy Services for Pets facility and not solely by the Buyer’s regular veterinarian. All costs associated with the necropsy, pathology, transportation, and related services are the sole responsibility of the Buyer.
Complete necropsy and pathology reports, along with all relevant veterinary records, must be provided to the Breeder before any replacement is considered. If the official necropsy and pathology findings establish that the puppy died as the direct result of a congenital or qualifying genetic condition covered under this guarantee, the Breeder will provide a replacement puppy of equal purchase value, subject to availability and the terms of this Agreement. Shipping, transportation, veterinary, necropsy, pathology, and other related expenses are not refundable and remain the responsibility of the Buyer.
6. No Guarantee of Disposition, Conformation, Size, or Breeding Ability
The Breeder does not guarantee the puppy’s future disposition, temperament, conformation, adult size, weight, color, markings, or breeding ability. Any estimated adult weight, size, appearance, or other characteristics are based upon the Breeder’s experience, knowledge, pedigree information, and previous litter development and are estimates only. If a puppy is sold with Full AKC Registration, the Breeder does not guarantee fertility of a male or female, breeding success, litter size, or show success. All expenses associated with breeding, reproductive care, pregnancy, delivery, veterinary care, or showing are the sole responsibility of the Buyer. Most puppies are sold with AKC Limited Registration. The Breeder reserves the right, at the Breeder’s sole discretion, to sell an individual puppy with Full AKC Registration.
7. Payment Disputes and Deposits
The Buyer agrees not to initiate a credit-card chargeback, payment reversal, or other payment dispute for this transaction without first contacting the Breeder in writing and providing the Breeder with a reasonable opportunity to address the issue in accordance with this Agreement and any applicable platform procedures.
All deposits are non-refundable, unless otherwise agreed to in writing by the Breeder.
8. Permanent Placement / Return to Breeder
This puppy is being placed as a permanent member of the Buyer’s family.
Under no circumstances should the puppy or adult dog be surrendered to a shelter, pound, rescue organization, or other third party without first notifying the Breeder. If, at any point during the dog’s lifetime, the Buyer is unable or unwilling to keep or properly care for the dog, the Buyer agrees to contact the Breeder before transferring possession or ownership.
The Breeder will gladly accept the dog back and will make reasonable efforts to place the dog in an appropriate forever home.
The Buyer understands that returning the dog to the Breeder does not entitle the Buyer to a refund or other monetary compensation. The Buyer is responsible for any shipping, transportation, or other costs associated with returning the dog to the Breeder.
This health guarantee is valid for one (1) year from the date of sale. The health guarantee becomes null and void if the puppy or dog is sold, transferred, given away, or otherwise placed with another party without the Breeder’s prior written consent.
