Spay/Neuter Contract

If this puppy is purchased as a pet, the Buyer agrees to have the puppy spayed or neutered by no later than twelve (12) months of age, unless otherwise agreed to in writing by the Breeder.

The Buyer must provide Luxurious Shih Tzu with a copy of the spay/neuter certificate from a licensed veterinarian immediately following the procedure. Failure to have the puppy spayed or neutered by twelve (12) months of age, or failure to provide proof of the procedure, shall constitute a material breach of this Agreement.

In the event of a breach, Luxurious Shih Tzu reserves the right to immediately reclaim possession and ownership of the puppy without refund or compensation to the Buyer. The Buyer agrees to surrender the puppy upon demand and shall be responsible for all costs incurred by the Breeder in recovering the puppy, including but not limited to attorney's fees, court costs, filing fees, travel expenses, transportation, and shipping costs.

If AKC Limited Registration papers are included as part of the purchase, they will be released only after the Breeder receives satisfactory proof of spay or neuter. Puppies sold on AKC Limited Registration may not be used for breeding or exhibited in AKC conformation events.

The Buyer further agrees that, for the lifetime of the dog, if they are ever unable or unwilling to keep the dog for any reason, the dog must be returned to Luxurious Shih Tzu. Under no circumstances shall the dog be surrendered, sold, given away, or placed in a shelter, rescue organization, or pound without the Breeder's prior written consent.

If the Buyer fails to comply with the spay/neuter requirement, the Buyer agrees to pay liquidated damages of $5,000.00, in addition to the original pet purchase price, as compensation for the unauthorized retention of breeding rights. Payment of this amount does not limit the Breeder's right to pursue any other remedies available under this Agreement, including repossession of the dog.
